Turk Allowed To Withdraw Guilty Plea For 2004 Attempted Murder

Rapper Tab “Turk” Virgil, 27, and former Hot Boy recently was allowed to withdraw his guilty plea for a murder case which he’s currently serving 12 years on a second degree attempted murder charge. According to the Commercial Appeal, The Tennessee appeals court ruled Thursday, February 21, 2008 that the rapper could withdraw his guilty plea because he entered them not knowing and understanding what he was admitting to.

The charge came after a shootout with police that took place during a raid on Jan. 26, 2004 where the rapper was stated to have been hiding in a closet at a Hickory Hill Apartment. Allegedly, the rapper was stated to have shot Shelby County SWAT member Chris Harris four times from the closet. Harris was reportedly shot in the jaw, thigh and calf as Turk allegedly opened the closet door.

Turk’s attorney stated he was arranging to have his client serve his sentence in federal prison, but the Federal Bureau of Prisons rejected his application. After being rejected, Turk then attempted to withdraw his guilty pleas, arguing that he believed he would serve his time in the federal system, but his petition was denied without explanation.

The appeals court strongly contended Thursday that Turk’s petition should have been granted.

“We conclude that the record in this case established that his pleas were not knowingly, voluntarily, and understandingly entered and that the pleas were entered through a misunderstanding as to their effects,” appellate judge J.C. Mclin wrote in an opinion that was joined by judges Alan Glenn and David Hayes.

The rapper would have faced up to 25 years in prison if convicted on the original charge of first-degree attempted murder.
